Home Buying Guide

Step 1: Determine Your Financial Readiness for Buying a Home

Determine your financial readiness for buying a home by evaluating your current monthly expenses, considering the minimum down payment required, deposit funds needed, closing costs, budget for future expenses, and keeping an eye on market conditions that can affect home prices. Be mindful that being approved for a certain mortgage amount does not mean you have to spend that much.

Step 2: Mortgage Prequalification

Mortgage prequalification is a process by which a lender gives you an estimate of how much of a mortgage you will likely be approved for based on your qualifications, such as your income and down payment amount. It is a tentative approval made in advance of a real estate purchase, and it helps you ensure that you are shopping for homes that you can afford. However, it is not a guarantee that a lender will enter into a mortgage contract with you, and the lender may choose not to approve you for a mortgage after more closely assessing you and/or the property.

Step 3: Finding the Perfect Home

Determine important factors such as location, home style, number of bedrooms and bathrooms, and features when searching for the perfect home. Make a list of your needs and wants to better focus your search. Consider property size and the Residential Measurement Standard (RMS) with your realtor. Be aware that a property's size isn't the only thing that affects its listing price. Consider material latent defects and stigmatized properties, and weigh the potential risks and benefits. Be aware of special situations such as "as-is, where-is" or "judicial sale/foreclosure" and their potential risks and restrictions.

Step 4: Making an Offer

Review the Real Property Report to ensure the property complies with municipal bylaws and regulations. Search the address of the property to uncover any information. Conduct a historical listing search to see the listing history of the property. Look into warranties and representations. Consider the offer price, deposits, terms, and conditions when writing the offer. Include possession date, inclusions and exclusions, time for acceptance/expiry of offer, pre-possession inspection, and conditions such as home inspection, financing, and condominium document review. Remember that all conditions need to have an expiry date, and if conditions are not waived in writing by their expiry date, the contract ends, and both parties have no further obligations to each other.

Step 5: Negotiation

After submitting an Offer to Purchase, the seller can accept, reject, make a counteroffer, or ignore your offer. In the event of a multiple offer situation, the seller will determine the process and may disclose the multiple offers to potential buyers. Your real estate licensee will advise you on the multiple offer situation, the seller's options, and your options such as increasing your offer, withdrawing the offer, or reconsidering the terms and conditions of the offer. They may also advise you on other considerations that could improve your position, such as adding a term or condition that compels the seller to deal with your offer or requiring the seller to not disclose the price and terms to any other buyer. If the seller accepts your offer, you will move forward with satisfying any conditions in your Offer to Purchase. If the seller rejects or ignores your offer, you can either submit a new offer or look for a different property.

Step 6: Satisfy Conditions

Review and confirm your financing before waiving the financing condition. Hire a licensed home inspector to examine the property and provide a written report of their findings for the home inspection condition. Review the condominium documents provided by the seller for the condominium document review condition. Sign the waiver provided by your real estate licensee once all conditions have been satisfied. Be confident in proceeding with the transaction before waiving the conditions, as not proceeding with the purchase can result in losing your deposit and may subject you to legal action.

Step 7: Preparing for Possession

Find and meet with a real estate lawyer to review legal documents, including the RPR and title. They will also discuss any restrictions or caveats registered against the property, closing costs, and disbursements. Title insurance is also discussed with your lawyer. Title insurance protects against future discoveries about the property, and it is a form of indemnity insurance for a mortgaged property. There are two types of title insurance: lender's title insurance, which the borrower usually pays for, and owner's title insurance, which either the buyer or seller pays to protect the buyer's equity in the property. Arrange for mail forwarding, utility hook-ups, home insurance, and hire a moving company (if using). Additional closing costs may include lawyer fees, title insurance costs, and property tax adjustments. Consult with your real estate licensee about any additional costs that may be expected in your market.

Step 8: Possession Day

On possession day, you will typically receive the keys to the property around noon. Before that, you may have a pre-possession inspection, which is a chance for you to ensure that the property is in the same condition as when you submitted your Offer to Purchase. You should check that all included items and appliances are still in place and in working order. Cleanliness is not typically a requirement, but if you find that the property is not in the same condition or that something has been removed that should not have been, you should contact your lawyer as it will become a legal issue between you and the seller. By the time you receive the keys, the money for the purchase has typically been transferred to the seller. Your real estate licensee may try to resolve the issue with the seller's representative, but if it is not resolved, your only recourse is to consult with your lawyer.

In the spring of 2015, we had the opportunity to work with Regan Tennyson. We were looking for a home for our University of Lethbridge daughter, but the home was being purchased by my brother from Ontario. We live in Calgary. Yes, you will need a deposit to secure your purchase contract. This could be 1% of the desired purchase price. So, for a $300,000 home, you would need a $3,000 deposit.
